The office of Public Notary is made by appointment. In Queensland Public Notaries are appointed by the Master of Faculties (an English civil servant), who represents the Archbishop of Canterbury.
Generally, a Public Notary is a long-serving practicing solicitor, who has specific functions, including:
- attesting legal documents;
- certifying that documents have been duly executed for use in Australia and overseas;
- preparing particular legal documents, such as powers of attorney, wills, deeds, and contracts for use in Australia and overseas;
- witnessing legal documents for use in Australia and overseas; and
- exemplifying official documents for use internationally;
